General Agreement Terms

VACATION RENTAL AGREEMENT & LIABILITY WAIVER

This agreement is made between Sandcastle CJPG, LLC (SCJPG) and the Guest, setting forth the terms of the vacation rental.

1. Property Information

  • Location: Sandcastle Villa & Beach House, Limestone Bay, The Valley, Anguilla, BWI AI-2640

  • Maximum Occupancy: 20 guests (including children of any age).

  • Unauthorized Additional Guests: Hosting additional guests beyond the agreed occupancy may result in immediate cancellation of the agreement with no refund.

2. Rates & Fees

  • Accommodation Tax: 13% Government Accommodation Tax included in the total rate.

  • Service Charge: Mandatory 10% service charge applies to all bookings.

  • Security Deposit: A credit card authorization form is required for security purposes.

3. Payment Terms

  • Deposit: 50% required at the time of booking.

  • Final Payment: The remaining balance is due 60 days before check-in.

  • Full Payment: Required at booking for reservations made less than 60 days before arrival.

  • Payment Methods: Wire Transfer (guest responsible for bank fees) or Credit Card (incurs 3% processing fee).

4. Cancellation Policy

  • More than 60 days before check-in: 100% refund, minus credit card processing fees.

  • 30 to 60 days before check-in: No refund of the deposit; however, the stay may be rescheduled within 12 months, subject to availability and prevailing rates.

  • Less than 30 days before check-in: No refund unless force majeure applies.

5. Force Majeure Cancellation Policy

  • 15 to 30 days before check-in: Full refund.

  • 14 days or less before check-in: 50% refund, and the remaining funds can be applied toward a future stay within 12 months.

  • Definition of Force Majeure:

  • Anguilla’s borders are closed.

  • Travel is legally prohibited between the guest’s location and Anguilla.

  • Natural disasters or property damage prevent safe occupancy.

6. Check-In & Check-Out

  • Check-In: 3:00 PM on the arrival date.

  • Check-Out: 11:00 AM on the departure date.

  • Late Check-Out: A fee of $500 applies for unapproved late departures.

7. House Rules & Property Use

  • Rental Rules: Guests must follow all rules in the agreement and attached Liability Waiver.

  • The property is not child-proof; children must be supervised at all times.

  • No diving is allowed in the swimming pool.

  • No lifeguard is on duty—ocean activities are at guests’ own risk.

  • Equipment Use:

  • Courtesy vehicles, bicycles, kayaks, and paddleboards are used at guests’ own risk.

  • Guests must check equipment condition before use.

8. Access to Property

SCJPG Staff & Management Access: Allowed for emergency, inspection, or repairs with 2 hours’ notice, unless in an emergency.

9. Travel Insurance & Liability

Travel Insurance: Strongly recommended to cover unforeseen disruptions.

Liability Waiver: Guests waive all claims against SCJPG, its employees, and affiliates for any injury, loss, or damage occurring during their stay.

10. Courtesy Vehicles

If Use of Villa Vehicles: Guests must obtain local driver’s licenses and are responsible for any damages.

11. Damages & Security Deposit

  • Guests must report any damages upon check-in.

  • Unauthorized removal or damage of household items (e.g., towels, keys, remotes, decorations) will result in charges.

  • Rearranging furniture is not permitted.

  • Guests are responsible for any breakage, loss, or damage beyond normal wear and tear.

  • A Security Deposit is required at Booking

12. Violation of Agreement

  • SCJPG reserves the right to cancel the stay without a refund if house rules are violated.

  • Security Deposit & Credit Card Authorization

  • Guests must complete a Credit Card Authorization Form for the security deposit.

  • Charges may apply for damages, lost items, or breaches of agreement terms.

Final Notes

  • Guests agree to mediate disputes before resorting to legal action.

  • Jurisdiction: Any legal disputes will be handled in Anguilla under local law.

  • Severability Clause: If any part of this agreement is found invalid, the remaining terms remain enforceable.
